Glaab's Request for a Partial Abandonment of <br />Live Oak Drive Right -of -Way <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of July 15, 1997. <br />D•a-RTPTTON AND rnNDTMTnNgi <br />Philip A. Glaab has submitted a petition for the abandonment of a <br />portion of Live Oak Drive right-of-way. The applicant is <br />requesting abandonment of a 10' strip of right-of-way that is <br />contiguous to his lot. The subject right-of-way segment is located <br />on the southwest side of Live Oak Drive, approximately 160' <br />southeast of the intersection of Live Oak Drive and Cathedral Oaks <br />Drive, in the Orchid Island Unit 2 Subdivision (see attachment #2). <br />The applicant is seeking abandonment of the 10' strip to create <br />additional setback area that would accommodate a proposed addition <br />to the front of his house. The Board is now to consider the <br />proposed abandonment and approve, approve with conditions, or deny <br />the request. <br />ANALYATC = <br />The existing 70' right-of-way for Live Oak Drive was created in <br />1960 via the Orchid Island Unit 2 subdivision plat. Although 60 <br />feet is the current minimum right-of-way width standard for a local <br />road designed with swale type drainage, some older subdivisions, <br />such as Orchid Island Unit 2, were platted with 70' rights-of-way <br />and constructed with a swale drainage system. Therefore, the width <br />of the subject right-of-way could be reduced by 10' and still <br />comply with the county's 60' standard. Also, the subject 10' <br />strip, if abandoned as right-of-way, would remain as a utility and <br />drainage easement as proposed by the attached abandonment <br />resolution. <br />The segment of right-of-way to be abandoned, where the subject lot <br />is located, is unique within the Orchid Island Subdivision. The <br />segment is located at a point along Live Oak Drive where the 18' <br />paved road curves and shifts from the middle to the eastern edge of <br />the right-of-way. Since the road is skewed within the right-of-way <br />the actual roadway edge is located a significant distance from the <br />applicant's front lot line. Thus, the distance from the nearest <br />roadway edge is 35 to 50 feet from the applicant's front lot <br />line, compared to a normal distance of about 251. Thus, in staff's <br />opinion, this is a rare case in which an isolated segment of a 70' <br />local road right-of-way can be abandoned without adverse right-of- <br />way or setback alignment impacts. If the 10' right-of-way is <br />abandoned, any proposed addition should have a setback from the <br />edge of roadway that is similar to the rest of the homes in the <br />area. <br />JULY 15, 1997 <br />
