ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Tippin, the Board, by a 4-0 vote <br />(Commissioner Macht being absent) unanimously approved <br />Cangianelli Construction's use of the Wabasso Beach Park <br />property for access to the beach, with conditions as follows: <br />(1) a written agreement be entered into with the contractor; <br />(2) the Park will be returned to its original condition than <br />before construction; (3) a $10,000 cash bond be placed to <br />guarantee that the Park will be restored and also this bond <br />may be used anytime by the County to replace or repair <br />damaged items in the Park resulting from the contractor's <br />activities; (4) no equipment or materials will be stored on the <br />Park site and the Park may only be used by the contractor for <br />ingress/egress, (5) no Park sand will be used for the <br />construction of an access ramp; (6) imposing a $500 per day <br />fine on the contractor should the 3 seawalls to the south <br />(King, Simpson and McCoy) not be completed by January 1St, <br />1998, and the 2 seawalls to the north (Hersh and Dinner Bell, <br />Inc.) not be completed by March 1St, 1998; and (7) if at any <br />time any of the above conditions are not met to County <br />staff's satisfaction, the agreement will be terminated <br />immediately and the matter returned to the Board of County <br />Commissioners for further action. <br />9.B.3.
