Cox, P.Ea3C <br />Civil Engineer <br />SUBJECT: Request for Floodplain Cut and Fill Balance Waiver for River Park Place <br />Phase I Planned Development <br />REFERENCE: PD -97-11-13 / 97080124-001 <br />DATE: October 24, 1997 <br />DESCRIPTION AND CONDITIONS <br />Knight, McGuire & Associates, on behalf of River Park Associates, Limited Partnership, the <br />developers of River Park Place Phase I Planned Development is requesting a waiver of the cut and <br />fill balance requirement of Section 930.07(2)(d) of the Stormwater Management and Flood <br />Protection Ordinance. River Park Place Phase I received preliminary plat and plan approval from the <br />Planning and Zoning Commission on September 25, 1997. The project is located in the southeast <br />corner of the 8' Street/Indian River Boulevard intersection adjacent to the north property fine of <br />Vista Gardens condominiums. The entire site is located in special flood hazard area Zone AE with <br />a base flood elevation of 6.0 feet N.G.V.D. The ten year stillwater elevation is 3.3 feet. The <br />proposed displacement of the floodplain below 4.0 feet for which the waiver is requested is 400. cubic <br />yards as indicated in the attached letter from the applicant's engineer dated August 20, 1997. <br />ALTERNATIVES AND ANALYSIS <br />The project meets the cut and fill balance waiver criteria provided in Section 930.07(2)(d)1. of being <br />situated in an estuarine environment within the100 year floodplain along the Indian River and in <br />staffs opinion it appears that all other Stormwater Management and Flood Protection Ordinance <br />requirements can be met without adverse impact on other lands in the estuarine environment. <br />A separate request for a Land Development Permit waiver has been received by the Public Works <br />Department. <br />Alternative No. 1 <br />Approve the cut and fill balance waiver request. <br />Alternative No. 2 <br />Deny the waiver request and require re -design to accomplish an on-site balance of cut and fill. <br />RECOMMENDATIONS <br />Staff recommends approval of Alternative No. 1. <br />NOVEMBER 4, 1997 97 BOOK 103 FAGE39 <br />
