Commissioner Adams questioned whether building permits were issued for this non- <br />conforming use, and Director Keating advised that no permits were issued; the work was <br />being done without permits and a " stop work" order was issued. <br />Attorney Barkett explained that the original building was a barn used to store <br />agricultural equipment and the purchaser assumed that the zoning designation was <br />agricultural. He applied to the Department of Environmental Protection for a packing house <br />permit and was not aware that he needed to apply to the County for permits. <br />Deputy County Attorney Will Collins addressed Commissioner Adams' concern and <br />stated that the main problem with a text amendment is that a lot of uses are allowed in <br />agricultural zoning which would not be compatible with residential zoning; such as sand <br />mines. He believed a text amendment would open a Pandora's box. <br />The Chairman asked if anyone else wished to be heard in this matter. There being <br />none, she closed the public hearing. <br />ON MOTION by Commissioner Ginn, SECONDED <br />by Commissioner Tippin, the Board unanimously <br />adopted Resolution 97-140 approving the transmittal of <br />a proposed amendment to the Indian River County <br />Comprehensive Plan to the State of Florida Department <br />of Community Affairs for its review (Thomas S. <br />Hammond - Amendment #LUDA 97-07-0166). <br />RESOLUTION NO. 97- 140 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, APPROVING THE TRANSMITTAL OF A PROPOSED <br />AMENDMENT TO THE INDIAN RIVER COUNTY COMPREHENSIVE PLAN TO THE <br />STATE OF FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS FOR ITS REVIEW. <br />WHEREAS, the Board of County Commissioners adopted the Indian River County <br />Comprehensive Plan on February 13, 1990, and <br />WHEREAS, the county received comprehensive plan amendment applications during its July <br />1997 amendment submittal window, and <br />WHEREAS, the Local Planning Agency held a public hearing on this comprehensive plan <br />amendment request on October 9, 1997 after due public notice, and <br />WHEREAS, the Local Planning Agency voted 3 to 1 to recommend that the Board of County <br />Commissioners transmit the comprehensive plan amendment listed below; and <br />NOVEMBER 4, 1997 47 c � <br />BOOK 103 PAGUE 343 <br />L <br />
