ON MOTION by Commissioner Ginn, SECONDED BY <br />Commissioner Macht, the Board unanimously approved <br />Alternative No. 1 to construct a six foot high wall at an <br />estimated cost of $77,887.20, as recommended in the <br />Memorandum.* <br />(CLERK'S NOTE: The Chairman went forward with the agenda to item 11.G.2., <br />but prior to its completion, acting on information from County Attorney Vitunac that <br />there were people who wished to speak on the previous matter, the Board decided to <br />reopen 11.G.1. There was a motion by Commissioner Adams and second by <br />Commissioner Tippin, with a unanimous vote in favor of the reopening. For purposes of <br />continuity, item 11.G.1. will be continued here.) <br />Andy Cindric, Lot 12, Kingswood Estates, spoke at length about the concerns of <br />the residents of the neighborhood. He passed four photographs to underscore his points <br />of information. (Clerk's Note: Photos are on file with the backup in the office of the <br />Clerk to the Board.) He understood the drainage canal was supposed to be maintained by <br />St. Johns River Water Management District a couple of times a year, but stated that it <br />actually happened only about every 5 years. One of the concerns was an always open <br />gate that is supposed to prohibit the public from entering the St. Johns River Water <br />Management District's property. They had concerns for the safety of their children and <br />the vegetation between their subdivision and the canal was sufficient to keep the children <br />and others away from the canal and acts as a buffer for roadway noises that will increase <br />when 58th Avenue is improved. He disputed many of the statements that he had heard <br />from staff. He thought a G high wall would not provide enough security. He pointed out <br />that Wal-Mart had an 8' wall to separate it from an abutting neighborhood. He noted that <br />the 43rd Avenue property owners were treated differently from the 58th Avenue property <br />owners; he felt he and his neighbors were not treated with the same courtesy. He stated <br />they would like to have the clearing of the vegetation called off, if possible. They would <br />like the effective height of the wall be a greater barrier against noise. He requested the <br />pine trees on the north side be retained. <br />In response to Commissioner Macht, Public Works Director James Davis advised <br />that the clearing would be done by the County's contractor. <br />54 <br />December 9, 1997 <br />
