2. Waiting until the property changes hands or is refinanced, in which case the <br />lien would be paid. Certain of the liens were only recorded in the <br />Assessment Lien Book pursuant to prior code procedures. If this <br />recommendation is followed, these liens should be recorded in the O.R. <br />Book in accordance with new code procedures. <br />Recommended Action: <br />Our office recommends Alternative #2 as the most cost-effective and certain way <br />to have the present and future delinquent accounts paid. <br />CPV/lk <br />Attachment: List of Delinquent Accounts <br />County Attorney Vitunac advised that Nancy Mossali had spent the last six months <br />doing a prodigious amount of work trying to collect some of the overdue assessments which <br />had become delinquent over the last number of years. He advised that she worked closely <br />with Tax Collector Karl Zimmermann's office staff. He called on Ms. Mossali to give a <br />report. <br />Legal Assistant Nancy Mossali described her collection efforts which resulted in a <br />collection rate of 721/o, 40 accounts remain unpaid. Of the original $159,377 that was due <br />as of June 30, 1997, $66,351.37 (P & I) is still remaining as of December 1, 1997. A total <br />of $93,025.63 was collected so far through her efforts. She recalled her conversations with <br />several people. Many of them thought their assessments were collected through their tax bill. <br />Also many had two assessments (one collected by Utilities Department and the other by the <br />Tax Collector) and the people were confused on which were paid and which were not. Many <br />elderly and disabled people could not afford to pay. Others live paycheck -to -paycheck and <br />could not afford to get a loan The mortgagee was copied on all the letters where taxes were <br />paid by the mortgagee and in some instances the holders of the mortgage have paid the <br />account and are collecting from their customer. Although the payment plan time has expired, <br />she has urged those who still owe to try to say ahead of the interest. <br />County Attorney Vitunac advised that the recommendation to the Board is to not <br />foreclose on the houses of these people, but that assessment liens be recorded in the Official <br />Records so they will be on record and the County will be paid off as a first lien whenever <br />there is any activity (sale or refinancing) on the property. The Board may foreclose if they <br />would like, however. Ms. Mossali is still taking phone calls and is putting a voice and face <br />to the County's letters; she has gotten a dialog going with people and advised them they <br />62 <br />December 9, 1997 <br />
