r- <br />BOOK 10PAGE 36 <br />There was a brief discussion about authorizing travel for Mr. Smith and County <br />Attorney Vitunac, and County Attorney Vitunac pointed out that it was actually in the <br />resolution before them. <br />Chairman Tippin cautioned that the County needed to be very watchful throughout <br />this entire Legislative Session. <br />The Chairman CALLED THE QUESTION and the motion <br />passed unanimously. <br />RESOLUTION NO. 98- 02 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, TO THE LEGISLATURE OF THE STATE OF <br />FLORIDA IN OPPOSITION TO HOUSE BILL 3291 <br />RELATING TO PUBLIC RIGHTS OF WAY AND THE <br />TELECOMMUNICATIONS INDUSTRY. <br />WHEREAS, there is presently Amendment #1 to House Bill 3291 before the <br />Utilities and Communications Subcommittee of the Florida House of <br />Representatives and other committees; and <br />WHEREAS, House Bill 3291 would prohibit local governments from <br />requiring any compensation other than for management costs for use of their <br />rights of way by telecommunication providers; and <br />WHEREAS, the acquisition, development, and maintenance of public rights <br />of way is an extremely expensive function of local governments which contributes <br />to the feasibility of the telecommunications industry; and <br />WHEREAS, this industry, as a profit-making enterprise, should contribute to <br />the cost of public right of way as a cost of business, <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. The Board of County Commissioners strongly opposes the passage of House <br />Bill 3291 as amended. <br />2. The Executive Aide to the Board is directed to provide a copy of this resolution <br />to the Local Legislative Delegation and to the committees to which this House <br />Bill has been assigned. <br />3. The County Telecommunications Officer and the County Attorney are <br />authorized to appear in person in Tallahassee at future Committee Meetings <br />on this Bill, if necessary. <br />32 <br />January 6, 1998 <br />
