Collins II - Deputy County Attorney <br />DATE: December 30, 1997 <br />SUBJECT: Lease Extension - Gifford Community Center <br />In discussing a lease for the Gifford Youth Activity Center, the representatives of <br />the Progressive Civic League of Gifford, Inc. have requested that I bring to the <br />attention of the Board of County Commissioners the fact that the current lease <br />for the Gifford Community Center which has a term of ten years will expire <br />October 26, 1998. They have requested an extension of that lease and the <br />following issues involved in lease extension should be addressed by the Board: <br />Tenn of the Lease. The initial term of the Gifford Community Center <br />lease was for 10 years. The lease as proposed for the Gifford Youth <br />Activity Center is 20 years. Since both facilities are leased to the <br />Progressive Civic League of Gifford, Inc. they have requested a <br />consistent term for the lease. They have requested that any lease <br />extension for the existing Gifford Community Center run for a term of 20 <br />years. <br />2. Description. The legal description of the lease should be modified to <br />less out that portion of the property previously leased for the Gifford <br />Community Center which is now physically occupied and proposed for <br />lease by the Gifford Youth Activity Center. <br />3. Renewal and Replacement. The existing lease makes the tenant <br />responsible for all repairs and improvements, but no provision has been <br />made for a renewal and replacement account or reserve. The Gifford <br />Youth Activity Center lease proposes that 5% of each year's operating <br />budget be held in a renewal and replacement reserve account to be <br />drawn upon when repairs are necessary to the facility. A similar provision <br />has been inserted in the lease extension for the Gifford Community <br />Center. A funding source would need to be identified through the annual <br />budgetary process. <br />4. Insurance. The County has updated insurance requirements since the <br />original lease. Current requirements are reflected in the proposed lease. <br />RECOMMENDATION: <br />Approve by Resolution a lease extension for the Gifford Community Center and <br />authorize execution by the Chairman. <br />38 <br />January 6, 1998 <br />0 0 <br />
