DeBlois, AICP <br />Chief; Environmental Planning <br />& Code Enforcement <br />DATE: February 24, 1998 <br />SUBJECT: Mike Rhodes Request to Speak to the Board Concerning Time Frames for <br />Relocating "The Landscape Stop" Wholesale/Retail Nursery Out of the <br />A-1 Zoning District <br />It is requested that the information herein presented be given formal consideration by the Board of <br />County Commissioners at its regular meeting of March 3, 1998. <br />DESCRIPTION & CONDITIONS <br />Mike Rhodes, owner of The Landscape Stop at 7950 85* Street, has requested to speak to the Board <br />of County Commissioners concerning the status of his efforts to relocate his wholesale/retail nursery <br />from his current business location (zoned A-1) to a commercially zoned property. <br />During land development regulation (LDR) amendment hearings in December, 1997, the Board <br />discussed and clarified its position regarding wholesale nurseries in the A 1 agriculture zoning district. <br />Specifically, the Board concluded that no retailing is allowed in the A-1 district associated with <br />wholesale nurseries, even as an accessory use. The Landscape Stop was discussed as an example of <br />a wholesale/retail nursery that is not allowed in the A-1 district, and during the LDR hearings, the <br />Board gave Mr. Rhodes 3 months to relocate his business to an appropriate zoning district. <br />In the meantime, the County Code Enforcement Board entered an Order requiring Mr. Rhodes to <br />either cease the retail aspect of his landscape business in the A-1 zoning district, or relocate the <br />business. The Code Enforcement Board entered its Order Finding Violation on October 27, 1997, <br />prior to the County Commission's discission of the matter. The Code Board's Order of October 271, <br />as amended, gave Mr. Rhodes until January 23, 1998, to resolve the matter. However, because of the <br />County Commission's decision in December, 1997 to give Mr. Rhodes 3 months to comply, the Code <br />Board subsequently extended its compliance date to March 20, 1998, to allow for the time frame <br />given by the County Commission. <br />March 3, 1998 <br />21 <br />
