FF- I <br />60ox <br />Community Development Director Bob Keating advised that staff has changed its <br />recommendation and is asking the Board to open the public hearing and discuss and consider <br />the issues but postpone the public hearing until next week's meeting as the Department <br />of Community Affairs (DCA) has not had a chance to review the changes made pursuant <br />to the Objections, Recommendations and Comments Report (ORC) received on February 2, <br />1998. The County has 120 days from receipt of the ORC to adopt the changes or take other <br />action and we are doing this in about 36 days. Staffwould be more comfortable waiting until <br />DCA has had a chance to examine the changes. Should the Board take action today, the <br />DCA would have no choice but to either accept or reject the amendments. <br />Director Keating continued that Objective 6 has been revised to reflect the input of <br />the discussions held with the citrus industry representatives as follows: <br />RECEIVED <br />• : J •CTT AgdodUg3d Protection <br />JLE TOTHESDARD <br />In recognition of the county's desire to protect ag[Jeulture despite ef&mffes and <br />MM"111IFT471-71n, <br />1%rough 2006, Indian PAYer C-ounty wiH have no act less of sefive 9gHetdtvrn1 6nd6 <br />Gurrenfly, <br />Policy 6.1: Indian River County shall not provide public services or facilities which would <br />induce or encourage the development of agriculturally designated lands except in the following <br />instances: <br />• To provide for the health, safety and welfare of existing residents; <br />• Lots or portions of lots which front on a public. roadway that serves as an urban service <br />boundary, as long as the provision of utility service is consistent with potable Water Sub - <br />Element Policy 5.9 and Sanit= Sewer Sub -Element Policy 5.9; and <br />• Agricultural Planned Developments. <br />Policy 6.2: To protect and conserve agriculturally designated lands, Indian River County shall <br />maintain its development regulations which control the division and development of <br />agriculturally designated lands. <br />Policy 6.3: Indian River County shall permit the continuation of agricultural uses within the <br />urban service area where those uses serve as or enhance open space and green belt areas of the <br />county. <br />Policy 6.4: Within the urban service area, the county shall require subdivision and planned <br />development projects that propose new residential lots adjacent to active agricultural operations <br />to provide special buffers. <br />Policy 6.5: Indian River County land development regulations shall require the following special <br />conditions for Administrative Permit, Special Exception and/or Planned Development approval <br />of projects on agriculturally designated land: <br />• Caribbean Fruit Fly host plants shall be prohibited on the subject site. That prohibition <br />shall be enforceable through the county code enforcement board; and <br />• A deed restriction shall be recorded and established on the subject site. That deed <br />restriction shall prohibit the occurrence of Caribbean Fruit Fly host plants on the subject <br />site and shall be acceptable to the county attomey's office. <br />MARCH 10, 1998 <br />• -52- <br />• <br />
