Oak Terrace Subdivision, Unit I - Recording of Final Plat <br />The Board reviewed a Memorandum of March 26, 1998: <br />TO: The Board of County Commissioners <br />FROM: Ve, William G. Collins 11- Deputy County Attorney <br />DATE: March 26, 1998 <br />SUBJECT: Recording of Final Plat of Oak Terrace Subdivision, Unit 1 <br />On March 4, 1997, the Board of County Commissioners approved the final plat <br />for Oak Terrace Subdivision, Unit 1 with a condition that prior to recording the <br />approved final plat, the developer post security to guaranty the Warranty <br />Maintenance Agreement for dedicated public improvements (streets, utilities, <br />drainage and stormwater tracts). <br />The developer, Peter Sabonjohn, Jr. as Trustee, never delivered security for the <br />Warranty Maintenance Agreement so the plat, although approved more than a <br />year ago, has not been recorded, hence no lots can be sold. <br />Mr. Sabonjohn is now requesting that the final plat be recorded in the absence of <br />the security contemplated at the time of final plat approval because the 1 year <br />warranty period has passed. Public Works and Utilities staff has inspected the <br />dedicated public improvements and have reported no defects in workmanship or <br />materials. <br />April 7,1998 <br />28 <br />
