County Attorney Vitunac administered the oath to the proposed witnesses and asked <br />that they note for the record that they had been sworn when they testify. <br />Planning Director Stan Boling noted he had been sworn and reviewed the <br />Memorandum. The site meets the general concerns of staff and there will be no new <br />overhead lines or poles to this site. I am introducing the entire memorandum and <br />attachments into the official record of your April 21, 1998 quasi-judicial hearing to consider <br />the special exception request. <br />A brief resume is attached that includes sufficient information to qualify me to present <br />substantial, competent evidence in a quasi-judicial hearing regarding land use issues. <br />This memorandum will reference and quote from the Indian River County Comprehensive <br />Plan and Land Development Regulations. As reference documents always available for public <br />inspection I would also want the entire Comprehensive Plan and Land Development <br />Regulations to be considered part of the record. <br />The site of the proposed electrical substation is designated M-1, Medium Density Residential <br />in the Comprehensive Plan and zoned RS -6, Single Family Residential. Electrical Substations <br />have been determined to be a special exception use in the RS -6 zoning district by County staff. <br />The Indian River County Land Development Regulations include general criteria for review of <br />special exception uses. The Land Development Regulations require that applicants present <br />evidence of compliance with the general criteria, as well as the specific criteria for the <br />particular special exception use cited in Chapter 971. Chapter 971.05(9) states: "The <br />applicant shall have the burden of establishing, by competent material and substantial <br />evidence, the existence of the facts and conditions which this chapter requires for approval." <br />APRIL 21, 1998 <br />E L'. �r ;c <br />
