• <br />Although the county does not desire to use the right-of-way portions requested for abandonment for <br />road building purposes, the portions could still be used for future drainage and utility purposes. <br />Therefore, the county engineering division is recommending that a drainage and utility easement be <br />retained over the entire area of the abandoned right-of-way. For that reason, the Resolution of <br />Abandonment expressly reserves a drainage and utility easement over the to -be -abandoned portions. <br />The proposed easement is worded to allow driveways to be constructed in the abandonment <br />portions. <br />Per guidelines established by the Board, this petition was reviewed by all county divisions and utility <br />providers having jurisdiction or potential interests within the right-of-way. All reviewing agencies <br />and departments have recommended approval of the requested abandonment, with the condition that <br />an easement for utilities and drainage be reserved over the abandoned portions. Furthermore, the <br />abandonment would not affect the right of convenient access to surrounding properties because no <br />roads will be closed and no existing roads will be constrained. Also, the County Attorney's Office <br />has reviewed and approved the attached abandonment resolution for legal form and sufficiency. <br />Based on the analysis performed, staff recommends that the Board of County Commissioners <br />abandon its rights to the subject right-of-way portions and authorize the chairman to execute the <br />attached abandonment resolution, with the following condition: <br />1. That the south 10' of I l' Lane S.E. and the north 10' of 121 Street S.E. right-of-way be <br />reserved as drainage and utility easements, with the allowance for driveway connection <br />across each right-of-way area. <br />TTACSMENT <br />1. Resolution <br />The Chairman asked if the Commissioners had any questions; there were none. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. There being none, he closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED BY <br />Commissioner Adams, the Board unanimously adopted <br />Resolution 98-047 which provides for the closing, <br />abandonment, vacation, and discontinuance of those portions of <br />11t` Lane SE and 12s` Street SE adjacent to Tract A, RIVER <br />SHORES ESTATES, UNIT 1, Indian River County, Florida, <br />and reserves a drainage and utility easement over the abandoned <br />right-of-way. <br />April 28, 1998 <br />31 <br />
