Community Development Director Authorized to Execute <br />License Agreements re Transferred -P o�nerty Utilizing County <br />Riparian Land forpocks within the Country Club Pointe Subdivision <br />The Board reviewed a Memorandum of May 18, 1998: <br />TO: The Board of County Commissioners <br />FROM: ',< William G. Collins II - Deputy County Attorney <br />DATE: May 18, 1998 <br />SUBJECT: Authorization for Community Development Director or His <br />Designee to Execute License Agreements Pertaining to <br />Transferred Property Utilizing County Riparian Land for Dodos <br />Within the Country Club Pointe Subdivision <br />An established policy by the Board of County Commissioners allows for property <br />owners within the Country Club Pointe Subdivision to enter into License <br />Agreements with the County for the use of the County's riparian land on the east <br />side of Calcutta Drive for the construction and use of docks for personal <br />recreational use. <br />Since the establishment of that policy, all available County riparian land on the <br />east side of Calcutta Drive is under license, and from time to time, property <br />owners under license sell their property and the new purchasers wish to exercise <br />the provision of the seller's license agreement whereby the new purchaser can <br />enjoy the same recreational enjoyment by entering into a similar license <br />agreement with the County within ninety days of sale. <br />Most purchase contracts, however, have contingencies that at closing the buyer <br />will be able to enter into a similar dock license agreement as did the seller, but <br />because closings are often on deadlines not consistent with scheduled meetings <br />of the Board of County Commissioners, delays in closings occur which can <br />cause lock -in rates with financial institutions to expire. <br />If the Board agrees that authorization of transfers of such license agreements <br />are an administrative function that can be delegated, review and approval of <br />each instrument by the Board and attendant delays in dosings can be avoided <br />by delegating authority to the Community Development Director or his designee <br />to execute License Agrdements pertaining to transferred property utilizing <br />County riparian land for docks within the Country Club Point Subdivision. <br />May 26, 1998 <br />13 <br />
