Policy 7.1 requires development to be consistent with regulations established by the National Flood <br />Insurance Program, and Future Land Use Element Policy 7.5 specifically states that stormwater <br />runoff from new development shall not negatively impact adjacent properties or receiving surface <br />waterbody quality. <br />Stormwater Management Sub -Element Policy 1.1 and Capital Improvements Element Policy 3.5 <br />actually set the drainage level of service standard for the county. These policies state that for a 25 <br />year/24 hour storm, post development runoff shall not exceed pre -development runoff unless a <br />maximum discharge rate has been adopted for the applicable drainage basin and the discharge does <br />not exceed that rate. <br />An additional requirement is found in Stormwater Management Sub -Element Policy 1.2 which <br />requires all new buildings to have the lowest habitable floor elevation no lower than the elevation <br />of the 100 -year flood elevation as shown on FEMA maps or as defined in a more detailed study. <br />Finally, Capital Improvements Element Policy 3.3 requires that the infrastructure necessary meet the <br />adopted level of service be in place concurrent with the impacts of new development. <br />All of these policies have been incorporated into the county's land development regulations, <br />particularly chapter 930, Stormwater Management and Flood Protection. Development of both <br />subject properties must be consistent with each of the referenced plan policies and land development <br />regulations. For these reasons, development of the subject properties under either the existing or <br />proposed land use designations would not degrade the floodplain or its storage capacity. Therefore, <br />the proposed amendment is consistent with these policies. <br />- Future Land Use Element Policies 1.3, 7.3, 7.4 and 7.6; and Conservation Element Policies <br />2.4, 5.3, 7.2, 7.3, and 7.4 <br />These policies relate to the protection of wetlands and/or environmentally sensitive lands. Future <br />Land Use Element Policies 1.3, 7.3, 7.4, and 7.6, and Conservation Element Policies 2.4, 5.3, 7.2, <br />7.3, and 7.4 require the county to adopt land development regulations that protect wetlands and <br />environmentally sensitive lands. These policies require environmental surveys, coordination with <br />other agencies, mitigation, setbacks, buffers, native plant preservation, and native plantings. <br />All of these policies have been incorporated into the county's land development regulations, <br />particularly chapter 928, Wetland and Deepwater Habitat Protection. Development of both subject <br />properties must be consistent with each of the referenced plan policies and land development <br />regulations. For these reasons, development of the subject properties under either the existing or <br />proposed land use designations would not adversely impact wetlands or environmentally sensitive <br />lands. Therefore, the proposed amendment is consistent with these policies. <br />- Future Land Use Element Policies 1.5 and 1.6 <br />Future Land Use Element Policy 1.5 states that the.conservation land use designations are applied <br />to those areas which are vital or essential to the normal functions of ecosystems and have been <br />identified in the Conservation Element as meriting preservation. Future Land Use Element Policy <br />1.6 limits the use of C-1 designated land to conservation and recreational uses. The wetlands that <br />currentiv exist and that will be created on Subject Property I meet the criteria set in Future Land Use <br />Element Policy 1.5. Because the proposed amendment redesignates Subject Property 1 to C-1, and <br />because the use of Subject Propenyl will be limited to conservation and recreational uses, the <br />amendment is consistent with Future Land Use Element Policies 1.5 and 1.6. <br />- Future Land Use Element Policies 1.15 and 1.16 <br />Future Land Use Element Policies 1.15 and 1.16 state that the commercial/industrial land use <br />desisnation should be within the urban service area and is intended for retail and wholesale trade, <br />offices, business and personal services, and similar uses. <br />Near the existing portion of the Horizon Outlet Center, adjacent to commercially designated and <br />zoned land, within the urban service area, with access to SR 60, and with urban services available, <br />Subject Property 2 is appropriate for commercial uses. The proposed amendment would allow <br />commercial development on Subject Property 2. Therefore, the proposed amendment is consistent <br />with Future Land Use Element Policies 1.15 and 1.16. <br />- Future Land Use Element Policy 1.17 <br />Future Land Use Element Policy 1.17 states that county land development regulations shall provide <br />performance standards for commercial/industrial development which at a minimum address the <br />following: <br />• eross floor area; <br />• impervious surface ratios; <br />• minimum open space; <br />• parking; <br />• buffering and landscaping; and <br />• environmental impact. <br />JUNE 291998 <br />
