• <br />ON MOTION by Commissioner Eggert, <br />SECONDED by Commissioner Ginn, the Board <br />unanimously adopted Ordinance 98-018 amending <br />the Zoning Ordinance and the accompanying Zoning <br />Map for a f2.7 acre tract located on the east side of <br />US 1 approximately 1.8 miles north of CR -510 from <br />CL to RM -6; amending the Zoning Ordinance and <br />the accompanying Zoning Map for a nearby f2.7 <br />acre tract from RM -6 to CG; and by amending the <br />Zoning Ordinance and the accompanying Zoning <br />Map for a nearby f2.1 acre tract from CL to CG; and <br />described herein, and providing severability and <br />effective date (Hale Indian River Groves, Inc.). <br />ORDINANCE NO. 98-18 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR A f2.7 ACRE TRACT, <br />LOCATED ON THE EAST SIDE OF US 1, APPROXIMATELY 1.8 MILES NORTH OF CR 510, <br />FROM CL TO RMA AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING <br />ZONING MAP FOR A NEARBY f2.7 ACRE TRACT, FROM RM -6 TO CG; AND BY <br />AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR <br />A NEARBY f2.1 ACRE TRACT, FROM CL TO CG; AND DESCRIBED HEREIN, AND <br />PROVIDING SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />A PARCEL OF LAND SITUATED IN A PART OF GOVERNMENT LOTS 5 AND 6, <br />SECTION 21, AND PART OF THE NORTHWEST QUARTER OF SECTION 28, <br />TOWNSHIP 31 SOUTH, RANGE 39 EAST, ALL LYING EAST OF U.S. HIGHWAY NO. <br />1, INDIAN RIVER COUNTY, FLORIDA MORE PARTICULARLY DESCRIBED BY <br />METES AND BOUNDS AS FOLLOWS. <br />JULY 79 1998 <br />-29- <br />
