Director Boling advised that he had distributed the Planning and Zoning Committee's
minutes of June 25, 1998 which reflect a unanimous vote in favor of this request. (Clerk's
Note: Copy of said minutes added to the backup for this item.)
Director Boling addressed concerns of Commissioner Ginn by advising that this will
be a commercial operation. The special exception will run with the land, but will be limited
in the future to the same type of business. He also explained the requirement under local
road standards for the 60' dedication of right-of-way.
DirectorBoling confirmed Commissioner Ginn's understanding that this matterwould
have to come back to the Board of County Commissioners if a change to any other type of
business was desired on this site.
The Chairman opened the public hearing and asked if anyone wished to be heard in
this matter. There being none, he closed the public hearing.
ON MOTION by Commissioner Eggert, SECONDED BY
Commissioner Ginn, the Board unanimously granted special
exception use approval for the proposed agricultural business
with the following conditions: 1) Prior to site plan release, the
applicant shall dedicate 60' of 26"' Street right-of-way to the
County without compensation; and 2) Prior to issuance of a
certificate of occupancy, the setbacks and buffering shown on
the proposed site plan and a Type "C" buffer with 3' opaque
feature along the southern boundaries of the project area of
development shall be provided, as recommended by staff.
(CLERK'S NOTE: The next item discussed by the Board of County Commissioners was
actually item I I.A.2. For purposes of continuity to the agenda, the minutes for that item
will be found in proper agenda order.)
July 14, 1998
33
