^a & <br />Commissioner Eggert pointed out that the Board was advising, not approving; the <br />Board of County Commissioners does the approving. <br />Commissioner Ginn understood, but felt the advice might be different. <br />County Attorney Vitunac stated that after he met with Commissioner Ginn and read <br />her memo, he asked Assistant County Attorney Terrence P. O'Brien to meet with Director <br />of Human Services Joyce Johnston -Carlson and go over the minutes and the ordinance to see <br />if what had occurred complied with our standards. As far as can be determined, there was <br />a technical violation in that the subcommittee members who voted on issues coming before <br />the board had not been approved as members by the Board of County Commissioners which <br />is required by the ordinance. <br />Vice Chairman Macht disagreed with County Attorney Vitunac's statement; he <br />believed there was no requirement for subcommittee members to be approved by anyone but <br />the CSNetwork members. <br />County Attorney Vitunac continued saying that he had asked Mr. O'Brien to meet <br />with Ms. Johnston to find out how to improve the ordinance and the guidelines to make <br />certain there are no areas of confusion like this in the future. Apparently, the guideline does <br />not mention that the Board of County Commissioners must approve subcommittee members, <br />however, the ordinance does and the ordinance takes precedence. So, the County Attorney's <br />office believes there was a problem with the subcommittee membership and the solutions to <br />the problem are really up to the Board of County Commissioners. The options range from <br />invalidating all the votes and sending them back to redo it, or after -the -fact approving the <br />membership of the subcommittees and accepting their vote, or approving the subcommittee <br />membership and asking them to review what they have already done to see if there would <br />be any change. <br />Vice Chairman Macht interjected that it was not necessary to have them review what <br />had already been done because before it comes to the Board of County Commissioners, there <br />will be additional changes, and they will get the CSNetwork report in its final form sometime <br />in the future. <br />County Attorney Vitunac resumed saying that ultimately, this is an advisory board to <br />the Board of County Commissioners which has to give whatever weight it chooses to the <br />deliberations of the CSNetwork and its subcommittee. If the Board chooses to continue with <br />the recommendations as voted, he would recommend that the ordinance be amended to <br />reflect the actual method of operation. <br />July 28, 1998 <br />58 <br />
