MCINNI.S - AGREEMENT AND RELEASE OF <br />UTILITY EASEMENT 8732 LAKESIDE BOUI.EVARD, VERO BEACH (LOT 1, <br />SEA OAKS RIVER HOMES IV PD) <br />The Board reviewed a Memorandum of July 23, 1998: <br />TO: The Board of County Commissioners <br />FROM: yam- William G. Collins II - Deputy County Attorney <br />DATE: July 23, 1998 <br />SUBJECT: Agreement and Release of Utility Easement <br />Indian River County has a 10 -foot wide utility easement over the southwesterly <br />portion of Lot 1 in Sea Oaks River Homes IV, P.D. The owner has requested <br />that the County release the utility easement so that he may put a swimming pool <br />in that portion of his lot. The Utilities Department has determined that the <br />easement is not needed. but the easement is occupied by a discontinued 6 -inch <br />water main. <br />Presented is an agreement for release of the utility easement in consideration of <br />the owner agreeing to be responsible for removal of the 6 -inch water main within <br />the easement and agreeing to hold the County harmless for any continuing <br />occupation of the easement by the water main until removed. <br />RECOMMENDATION: <br />Authorize the Chairman to execute the attached Agreement and Release of <br />Utility Easement. <br />ON MOTION by Commissioner Adams, <br />SECONDED by Commissioner Ginn, the Board, by <br />a 4-0 vote (Commissioner Eggert being absent), <br />unanimously approved the Agreement and Release <br />of Utility Easement with Robert and Abby W. <br />McInnis, releasing a 20 foot utility easement situated <br />in part of Lot 1 of "Sea Oaks River Homes IV, <br />P.D.", and authorized the Chairman to execute same, <br />as recommended by staff. <br />AGREEMENT IS ON FILE IN THE OFFICE <br />OF THE CLERK TO THE BOARD <br />August 4, 1998 <br />• -10- <br />• <br />
