• <br />• <br />Based on the analysis, staff and the Planning and Zoning Commission recommend that the Board <br />of County Commissioners approve Alternative 3 and rezone the entire subject property to RS -6 by <br />adopting the attached rezoning ordinance. <br />ATTACHMENTS <br />1. Rezoning Application <br />2. Location Map <br />3. Approved minutes of the July 23, 1998 Planning and Zoning Commission meeting. <br />4. Rezoning Ordinance <br />Deputy County Attorney William G. Collins ll explained this is an appeal of the <br />denial of a multi -family rezoning request. The property is currently zoned agricultural and <br />when it went before the Planning and Zoning Commission (PZC), the applicant requested <br />a combination of single family and multi -family zoning. Based on staff's recommendation <br />and input at the public hearing, the PZC approved the rezoning to RS -6, but denied the multi- <br />family request. From that denial, the applicant has taken an appeal to the County <br />Commission with respect to the multi -family zoning. The attorney for the applicant has <br />requested that this hearing be continued to September 1' because one of the parties he <br />wished to testify was not able to be present. Since it is his appeal, Attorney Collins thought <br />he had the right to a continuance, but because it had been advertised as a public hearing <br />today, he believed it would be advisable to open the public hearing, hear comment from <br />anyone that would not be able to attend the continued hearing next week, but leave the main <br />body of the discussion and the analysis to next week's hearing. He suggested that after the <br />hearing is opened, the matter be continued to next week at 9:05 a.m., so the hearing would <br />not have to be re -advertised. <br />Chairman Tippin understood and agreed with Attorney Collins that it was the right <br />thing to do. He read the title of the ordinance into the record. <br />Commissioner Eggert understood they would not be hearing stafr s presentation and <br />analysis at the meeting, but that would be heard next week. <br />Attorney Collins confirmed her understanding adding that he felt it would be more <br />appropriate to hear everything next week other than anyone who wished to speak at this <br />meeting. <br />August 25, 1998 <br />45 <br />BOOK AG PAGE 6401 <br />
