BOOK DO F,16E d J <br />Donald Anderson, 945 Island Club Place, Vero Beach, had been sworn and expressed <br />his support for the applicant's request. <br />Adele Zabrows1d, an Indian River County resident, felt it was appalling to be <br />discussing objections to multi -family zoning when the County has residents who don't even <br />have a place to live. <br />Alex Drutz had been sworn and supported the applicant's request. <br />Attorney Ralph Evans, 3355 Ocean Drive, Vero Beach, had been sworn and is the <br />attorney for the applicant. He noted that the law says this is a property designated L-2 which <br />can be zoned RM and RS -6. All issues brought up by staff were satisfied except for the <br />compatibility issue which he did not find in the Code. He had found that decisions about <br />compatibility are usually found to be arbitrary and capricious. He explained that the <br />applicant did not file a request for a PD because it costs more and they had already been told <br />that the multi -family zoning could not be in the location they wanted. He felt because there <br />are only 2 or 3 lots fronting the Marbrisa development, the request should be simpler. The <br />County's Code says that RM -6 is permissible in this area. <br />Mr. Evans read from several court cases and stated that the landowners have a right <br />to this zoning and the Board has no reason to deny this zoning. <br />Marilyn DeVries, 760 Marbrisa Lane, Vero Beach, had been sworn and hoped the <br />Board would encourage the developer to make the transition between their development and <br />Marbrisa more pleasing. <br />Ben Casey, 650 Marbrisa River Lane, Vero Beach, had been sworn and opposed the <br />multi -family zoning. <br />Theodore Hirsch, 425 Ventura Place, Vero Beach, was opposed to the multi -family <br />zoning. <br />The Chairman asked if anyone else wished to be heard regarding this matter.
