RENEWAL OF CLASS E CERTIFICATE OF PUBLIC <br />CONVENIENCE AND NECESSITY TO PROVIDE WHEELCHAIR <br />TRANSPORTATION SERVICES - ABLE HEALTH SERVICES <br />The Board reviewed a Memorandum of September 14, 1998: <br />TO: Honorable Board of County Commissioners <br />THROUGH: James E. Chandler, County Administrator <br />FROM: Doug Wright, Director <br />Emergency Services <br />DATE: September 14, 1998 <br />SUBJECT: Approval of Renewal of a Class E Certificate of Public Convenience and Necessity <br />for Able Health Services to Provide Wheelchair Transportation Services <br />On August 31, 1995, during the regular meeting of the Transportation Disadvantaged Local <br />Coordinating Board, the Board recommended to the County Commission that an ordinance be <br />adopted to require a Certificate of Public Convenience and Necessity (COPCN) for the regulation <br />of wheelchair transportation services. On Tuesday, September 19, 1995, the Indian River County <br />Board of County Commissioners approved regulations governing wheelchair services as noted in <br />Chapter 304, Life Support and Wheelchair Services, and more specifically in Part H, Wheelchair <br />Vehicle Services. A Class "E" Certificate is described in the Indian River County Code <br />referenced above as "Any person who provides wheelchair vehicle services where said services are <br />paid for in part or in whole either directly or indirectly with government funds shall be required <br />to have a Class "E" Certificate. " <br />Able Health Services was one of several applicants for a Class E Certificate and subsequent to <br />meeting the provisions of Chapter 304, Able was granted a Class E Certificate on September 24, <br />1996, which expires on September 24, 1998. Able Health Services is not under contract with the <br />Transportation Coordinator and currently operates with the Board stipulation as a private pay only <br />service. The service has recently undergone an inspection of vehicles, facilities, and records by <br />the State EMS Office and staff from the Department of Emergency Services. <br />The Indian River County Code provides for routine renewal of certificates of public convenience <br />and necessity on application by the certificate holder. This can be accomplished without a public <br />hearing if the Board has no reason to believe that the public health, safety, and welfare require it. <br />Staff submits that there is no reason at this time to hold a public hearing and absent that <br />requirement, requests the Board issue and renew the certificate routinely. <br />RECOMMENDATION: <br />Staff recommends the Board approve the renewal of a Class E Certificate of Pubic Convenience <br />and Necessity for Able Health Services to provide wheelchair transportation services for two years <br />pursuant to Chapter 304 of the Indian River County Code of Laws and Ordinances. <br />ATTACHMENTS: <br />Copy of renewal application. <br />List of current COPCN providers (all classes) and copy of Chapter 304. <br />September 22, 1998 <br />BOOK 107 PAGE !2 <br />
