Heath, CCEP <br />Code Enforcement Officer <br />DATE: October 27, 1998 <br />SUBJECT: Release of Easement Request by Sea Oaks Investments, LTD, Relating to a <br />County -Abandoned Flow Well and Water Main <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of November 3, 1998. <br />The County has been petitioned by Sea Oaks Investments, LTD, owners of the subject property at 1235 <br />Winding Oaks Circle East, for the release of a twenty (20) foot County utility easement that was <br />originally dedicated to supply an on-site water treatment facility (see the attached location map and <br />easement depiction). The original on-site water treatment plant has been abandoned, and the area is now <br />served by County utilities. It is the petitioner's intention to release the easement, which contains an <br />abandoned flow well and water main, to allow for a future phase of Sea Oaks development in the area of <br />the easement. <br />The request has been reviewed by Bell South Communications; Florida Power & Light Corporation; <br />T.C.I. Cable Corporation; the Indian River County Utilities Department; the County Road & Bridge and <br />Engineering Divisions; and the County surveyor. None of the utility providers expressed an objection to <br />the requested release of easement. Therefore, it is staff's position that the easement release would have <br />no adverse impact to utilities being supplied to the subject property or to other property. <br />The easement proposed for release is in the vicinity of an area containing archaeological resources <br />associated with what is known as the `Blue Goose Midden." Staff's position is that the issue of potential <br />impacts to archaeological resources on the property will be addressed via the site plan review process at <br />the time of proposed development, and therefore should not be considered an impediment to County <br />release of the easement. <br />November 3, 1998 <br />13 <br />
