Keating, AIC <br />Community Development Director <br />A .A - <br />THROUGH: Stan Boling, AICP <br />Planning Director, Current Development <br />FROM: John McCoy, AICP �� V\ <br />Senior Planner, Current Development <br />DATE: November 2, 1998 <br />SUBJECT: Request For Abandonment of Portions of 10t° Street Between 37`h Avenue and <br />41" Avenue <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of November 10, 1998. <br />A petition has been submitted to abandon segments of 10" Street between 3r and 4111 Avenues. <br />The right-of-way segments are located between a portion of Malaluka Gardens (platted in 1955) <br />and the newly platted Laurel's Subdivision (see attachment #2). Both developments and the adjacent <br />area are zoned for and developed as single-family lots. The subject right-of-way segments are 35' <br />wide "half -street" right-of-way segments and are located immediately south of Malaluka Gardens <br />lots. <br />This right-of-way abandonment request evolved during the recent, review and approval of the <br />Laurels Subdivision phases III and IV final plat. Since the subject portions of 101 Street do not <br />provide the sole direct access to any adjacent lots, do not provide access to the Laurels Subdivision, <br />are substandard in width and are unpaved, these segments are candidates for abandonment. <br />The referenced segments of 10'h Street right-of-way were created and "constructed" as an unpaved <br />half -street in 1955 via approval of the Malaluka Gardens plat and corresponding development. <br />Though the plat, a 35' wide half street right-of-way was established between 37th and 43nd Avenues. <br />The unpaved roadway was dedicated to and is maintained by the county. East of 37t1 Avenue, 10t, <br />Street is a full street and is used by area residents, with some residents directly accessing 10`h Street <br />from their driveways. Presently, the subject portion of 10' Street functions as an unpaved east/west <br />local road. Staff has been contacted by local residents who have expressed both opposition and <br />support for the proposed abandonment. <br />Located to the south of and contiguous to l0U' Street, the Laurels Subdivision was originally <br />approved to connect to 101 Street, provide 25' of right-of-way to convert the subject segment of 10th <br />Street from a half -street to a full street, and pave 10t1 Street from 37th Avenue to the subdivision's <br />November 10, 1998 <br />24 <br />0 40 <br />
