,flux 107 'b <br />Please see attachment #2 which depicts the access conditions that will exist if the proposed <br />abandonment is approved If the request is approved, there would be an unpaved T turn around <br />at the south end of 401 Avenue. An extended paved "T" turn around will be provided by Public <br />Works at the south end of 39* Avenue, with the paved extension to the west providing paved access <br />to the emergency access point located at the north end of The Laurels. A paved "T" turnaround will <br />also be provided at the south end of 381" Avenue. <br />Conclusion <br />The subject right-of-way is not part of the roadway system as noted on the County's thoroughfare <br />plan and is not needed for the thoroughfare plan system. The abandonment would not eliminate <br />access to any properties, and local traffic could use other existing, nearby streets in the neighborhood <br />if the right-of-way is abandoned Additionally, the abandonment would eliminate a permanent half - <br />street and expenses for road grading and/or future paving. The County Attorney's Office has <br />reviewed and approved the attached abandonment resolution for legal form and sufficiency. <br />Therefore, in staffs opinion the proposed abandonment is warranted. <br />Based on the above analysis, staff recommends that the Board of County Commissioners abandon <br />its rights to the subject 10* Street right-of-way segments and authorize the Chairman to execute the <br />attached abandonment resolution, with the following condition: <br />1. That over all segments of the right-of-way to be abandoned a drainage and utility <br />easement shall be reserved <br />1. Location Map <br />2. Sketch of Survey <br />3. Resolution <br />Director Boling responded to concerns of the Commissioners regarding <br />responsibilities for future maintenance of the property and paving the turn -around T's <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. <br />Ann Gaskell, 1025 30 Avenue, spoke at length against the abandonment and cited <br />various concerns, such as regular use of the one-way street by some residents of Malaluka <br />Gardens; creation of a hazard for emergency vehicles; and creation of an impediment to FPL <br />access. She complained that since August, 10' Street had been narrowed considerably due <br />to installation of a berm and suggested it be removed. She asked three questions: 1) Why the <br />street area portions are being abandoned and closed off. 2) Who decided to go ahead with <br />this proposed abandonment. 3) Was a survey completed regarding the vehicles which use <br />the street and the results. <br />November 10, 1998 <br />26 <br />
