• <br />ON MOTION by Commissioner Ginn, SECONDED <br />by Commissioner Macht, the Board, by a 3-2 vote <br />(Commissioners Adams and Stanbridge opposed) <br />granted the special exception use approval for the <br />education facility with the following conditions: (1) <br />prior to site plan release, the applicant must confirm <br />that the educational facilities will meet the minimum <br />spatial requirements utilized by the Indian River <br />County School Board and the State of Florida; (2) <br />the property owner shall not permit the planting of <br />and shall allow for the removal of any wild growing <br />Caribbean fruit fly host plants; prior to the issuance <br />of a Certificate of Occupancy for Phase I, (3) the <br />sidewalk along 58'b Avenue shall be constructed or <br />otherwise guaranteed in accordance with County <br />regulations; (4) the project's 12' Street frontage <br />shall be paved from 58'h Avenue to the nearest 12`h <br />Street driveway; (5) the developer shall construct a <br />westbound left turn lane for the project's <br />easternmost 12" Street driveway; (6) that the lighting <br />of any recreational field must be approved by the <br />Planning and Zoning Commission; (7) between the <br />west site boundary and the proposed tennis courts, a <br />setback of at least 100 feet shall be maintained and <br />a 50 foot setback shall be maintained for the <br />proposed soccer and baseball fields; (8) prior to <br />issuance of a Certificate of Occupancy for Phase I, <br />a Type "B" buffer shall be installed and maintained <br />along the entire west property line; and (9) prior to <br />construction or use of all fields and outdoor <br />recreational improvements within Phase III, the <br />applicant shall obtain final site plan approval for <br />such uses/facilities from the Planning and Zoning <br />Commission. <br />NOVEMBER 17, 1998 <br />-39- <br />• <br />BOOK 10.7 PnE 654 <br />
