In order to <br />correct the scriveners error and keep the public records clear, staff has prepared a corrected <br />resolution to be recorded in lieu of the resolution attached to the November 10, 1998 staff report. <br />The scriveners error did not have an effect on the public hearing. By substituting the revised <br />resolution, the public records will be clearer. The substitute resolution would keep the same <br />resolution number. <br />Based on the above, staff regommends that the Board of County Commissioners adopt the attached <br />substitute resolution. <br />ON MOTION by Commissioner Adams, <br />SECONDED by Commissioner Stanbridge, the <br />Board unanimously adopted Corrective Resolution <br />98-122 providing for the closing, abandonment, <br />vacation and discontinuance of a segment of lo' <br />Street between 3r Avenue and 41' Avenue, and <br />reserving a drainage and utility easement over the <br />abandoned right-of-way, said land lying in Indian <br />River County, Florida (CLERK'S NOTE: <br />ORIGINAL RESOLUTION ADOPTED <br />a <br />NOVEMBER 10, 1998). <br />CORRECTIVE <br />RESOLUTION NO. 98-122 <br />Q <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br />_., <br />ABANDONMENT, VACATION AND DISCONTINUANCE OF A SEGMENT OF <br />8 <br />10TH STREET BETWEEN 377H AVENUE AND 41sT AVENUE, AND <br />: <br />I <br />RESERVING A DRAINAGE AND UTILITY EASEMENT OVER THE <br />ABANDONED RIGHT-OF-WAY SAID <br />LAND LYING IN INDIAN RIVER <br />e' <br />COUNTY, FLORIDA <br />WHEREAS, on August 19, 1998 Indian River County received a duly executed and <br />documented petition, requesting that the County close, vacate, abandon, discontinue, renounce and <br />disclaim any right, title and interest of the County and the public in and to a portion of 10th Street <br />between 37'" and 4191 Avenue, said lands lying in Indian River County, Florida, and <br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to <br />consider said petition was duly published, and <br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and <br />report, and testimony of all those interested and present, the board finds that the subject right-of-way <br />is not a state or federal highway, nor located within any municipality, nor is said right-of-way <br />necessary for continuity of the County's street and thoroughfare network, nor access to any given <br />private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1.
