Planning Director Stan Boling reviewed some changes in applicant's request. The <br />site plan does not meet the driveway separation criteria and would need to be re -designed. <br />The applicant is withdrawing their request to convert the existing structure to a packing <br />house so there is no longer an appeal of the site plan issue. If applicant's request is granted, <br />there will be a condition imposed to meet the normal site plan requirements. That structure <br />could continue to be used as a barn for fruit from this site only. The current request is for <br />an agricultural business office which would be housed in the existing residence. Staff feels <br />this business is definitely related to agriculture. However, the Planning & Zoning <br />Commission recommended denial because it is probably an office use more appropriately <br />located in the business district. Staff also concludes that the planned use is a commodities <br />brokerage use which is more appropriately located in an office or commercial district. Staff <br />and P&Z recommend denial of the special exception request. The site plan appeal portion <br />is moot. <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. <br />Randy Mosby, of Mosby & Associates, representing DLF, Inc., confirmed that the <br />applicant does not intend to utilize the barn as a packing house and does intend to remove <br />the driveway. The site plan has not been revised because they wanted the Board's input first. <br />The only disagreement seems to be whether the business office would be more appropriately <br />located in a commercial area. <br />Bill Mills, Real Estate & Management Group, agent for the seller, noted that Seald- <br />Sweet is the same style of business and is located in RM -6 zoning. The surrounding <br />neighborhood is RM -6 or agriculture and there is 400 feet of buffering between the closest <br />neighbor. He believed that this site is in compliance. <br />Commissioner Adams felt that staff agreed this is an agricultural business. The hang <br />up seems to be whether the office would be more appropriately located in another zoning <br />district. She believed that this is an appropriate place for the agricultural business and felt <br />the special exception approval would be very minor compared to the school recently <br />approved in an agricultural area. <br />DECEMBER 1, 1998 <br />-29- FOOK <br />107 FKE,75U <br />
