Boor 107 PAGE 759 <br />Although the county does not desire to use the right-of-way for mad building purposes, the right -of. <br />way could still be used for future drainage and utility purposes. Therefore, county staff is <br />recommending that a drainage and utility easement be retained over the entire area of the abandoned <br />right-of-way. For that reason, the Resolution of Abandonment expressly reserves a drainage and <br />utility easement over the to -be -abandoned right -0f --way segment. <br />Per guidelines established by the Board of County Commissioners, this petition was reviewed by all <br />county divisions and utility providers having jurisdiction or potential interests within the right-of- <br />way. In addition, per county regulations, adjacent property owners were notified by mail prior to <br />staffs review meeting (the Technical Review Committee meeting of September 9, 1999). All <br />reviewing agencies and departments have recommended approval of the requested abandonment, <br />with the condition that an easement for utilities and drainage be reserved over the abandoned area. <br />The subject right-of-way is not part of the roadway system as noted on the County Thoroughfare <br />Plan, and is not needed for the thoroughfare system. Furthermore, the abandonmentwould not affect <br />the right of convenient access to surrounding properties. Also, the County Attorney's Office has <br />reviewed and approved the attached abandonment resolution for legal form and sufficiency. <br />Based on the analysis, staff recommends that the Board of County Commissioners abandon its rights <br />to the subject right-of-way and authorize the chairman to execute the attached abandonment <br />resolution, with the following condition. <br />That the entire right-of-way area be reserved as a drainage and utility easement. <br />Planning Director Stan Boling advised that this is a paper half street and releasing the <br />area will allow Mr. and Mrs. Hansen to have a larger buildable area. There is no need for <br />a road and no objections from the various utilities. Staff would like to reserve a drainage and <br />utility easement. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. There being none, the Chairman closed the public hearing. <br />ON MOTION by Commissioner Macht, <br />SECONDED by Commissioner Adams, the Board <br />unanimously adopted Resolution 98-133 providing <br />for the closing, abandonment, vacation and <br />discontinuance of a portion of Sunrise Street south <br />of 87' Street and adjacent to Lot 14, Block 7, Weona <br />Park Subdivision and reserving a drainage and utility <br />easement over the abandoned right-of-way, said land <br />lying in Indian River County, Florida. <br />DECEMBER 1, 1998 <br />0 <br />-32- 0 <br />
