BOOK x.03 PAGE 435 <br />The staff was directed to prepare an RFP to see if a contract for these services was <br />feasible. Chief Judge Kanarek, Julia Graves, a member of the Indian River County Bar <br />Association, and I were designated as the committee to review the RFPs and make a <br />recommendation to the Board of County Commissioners. <br />Only one RFP was received, but it was a joint effort of two law firms, i.e., Hammond and <br />Smith, P.A. and Michael Berry, P.A. In addition, it was represented that attorneys Kevin <br />MacWiliiam and James Harpring would be assigned cases. <br />The committee met in Judge Kanarek's chambers today, and it was agreed at the outset <br />that the attorneys in the applicant law firms were well qualified in this area of the law. <br />A detailed analysis and estimate of the time involved was made, and it was determined <br />that the proposed fee of $950 for the initial stage up to and including adjudication of <br />dependency was reasonable. For those cases that go beyond adjudication an additional <br />fee of $950 was proposed. The committee after review and analysis determined that this <br />was a reasonable fee. Where legal assistance beyond this is required the charge would <br />be $40 per hour. This was also considered reasonable. <br />In view of the foregoing, the committee recommends to the Board that it contract with <br />the applicant for these required services. It was noted that this proposal is very similar <br />to the existing contract in St. Lucie County. <br />This office will, of course, monitor the program to determine if it is cost effective. <br />Recommendation: Staff recommends that the attached contract be approved and that <br />the Chairman be authorized to execute it on behalf of the Board. <br />ON MOTION by Commissioner Adams, SECONDED BY <br />Commissioner Ginn, the Board unanimously approved the <br />agreement to provide legal representation for indigent persons <br />in dependency cases in Indian River County, with Hammond <br />and Smith, P.A. and Michael Berry, P.A., and authorized the <br />Chairman to execute same, as recommended in the <br />Memorandum. <br />AGREEMENT IS ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />8.
