r <br />BOOK 103 PAGE 575 <br />which had been done. He presented rights-of-way needs and advised paving requirements <br />for the thoroughfare plan roads within the area of TND. He indicated the development <br />would accelerate the need for improving the thoroughfare plan roads. Also, he generally <br />explained the phasing. He mentioned the hotel and ALF total care limits. He advised that <br />generally the setbacks are greater farther from town center and pointed out that there is less <br />density away from the town center. He called attention to the section in the memorandum <br />concerning the annual reports (#24). He closed his presentation with staff's recommendation <br />to approve the rezoning with the conditions enumerated in the memorandum and pointed out <br />that the first 9 conditions occur at the front end of the development. He once again stated <br />that this has been essentially treated as a DRI with the attendant requirements and offered <br />to answer any questions the Commissioners might have. <br />The Commissioners made inquiries concerning the streets which will go through the <br />TND, setbacks, buffering, impact on Westlake Estates, and other concerns, to which staff <br />responded. <br />Because of Commissioners' serious concerns about 16* Street and the impact on the <br />homes in Westlake Estates, Public Works Director James Davis discussed preliminary ideas <br />on paving and canals in that area. <br />Commissioners presented several alternative suggestions which would create less <br />impact on the Westlake Estates' homeowners and Director Davis cautioned that the <br />suggested culverting of the canal was a very costly solution and the intersection of 16t` Street <br />and 74th Avenue would then be off -set. Ultimately, he thought relocating the canal would <br />be less costly than culverting at $110/foot. <br />The Chairman declared a 5 -minute recess at 10:10 a.m. and the meeting was <br />reconvened at 10:18 a.m. with all Commissioners and staff present. <br />There were no further questions of staff and the Chairman opened the public hearing <br />and asked if anyone wished to be heard in this matter. <br />Attorney Bruce Barkett appeared for the applicant and pointed out that the <br />application was not only supported by staff but also by the Planning and Zoning <br />Commission. He offered to answer any questions the Commissioners might have.
