BOOK 103 PAGE 055 <br />County Attorney Vitunac advised that this hearing is legislative because the County <br />owns the properties. <br />Community DevelopmentDirectorBob Keating exphuned the amendments andnoted <br />that there are 2 actions required on each tract. The land use designation change can be <br />adopted today on each of the 3 parcels. However, the rezoning can take place only on the <br />Irwin tract as state law requires 2 public hearings on a County -initiated rezoning where the <br />parcel exceeds 10 acres. The second public hearings must be after 5 p.m. unless waived by <br />the Board. The Department of Community Affairs (DCA) has not filed any objections to any <br />of the requested redesignation or rezonings. The parcels are: (1) the Irwin tract which is <br />a part of the Jungle Trail Conservation Area, oceanfront, environmentally significant, and <br />purchased jointly with the State; (2) the Flinn tract which was purchased jointly with St. <br />John River Water Management District and FIND; and (3) the Green Saltmarsh tract which <br />was donated to the County. <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. There being none, the Chairman closed the public hearing. <br />ON MOTION by Commissioner Stanbridge, <br />SECONDED by Commissioner Ginn, the Board <br />unanimously adopted Ordinance 99-007 amending <br />the Future Land Use Element of the Comprehensive <br />Plan by Changing the Land Use Designation for an <br />f 8 acre tract located on the East side of SR AlA <br />just north of the Town of Indian River Shores from <br />L-2 to C-1 (Irwin); by Changing the Land Use <br />Designation for a f 37 acre tract located at the <br />Northeast corner of 8'h Street and Indian River <br />Boulevard from M-2 and C-2 to C-1 Minn); and by <br />Changing the Land Use Designation for a f 15.8 <br />acre tract located west of St. Christopher's Harbor <br />Subdivision from C-2 to C-1 (Green Saltmarsh). <br />MARCH 16, 1999 <br />-40- <br />
