I <br />BOOK 103 PAGE 9 <br />Emergency Services Director Doug Wright advised that the original contract had been <br />approved on February 16, 1999. At that time, 2 changes were recommended by the County <br />Attorney regarding the terms of payment and the venue for any litigation. Ericsson agreed <br />with the change in the terms of payment but advised they are trying to consolidate the venue <br />for any litigation which may arise from the Y2K situation. <br />County Attorney Vitunac noted that Ericsson has us over a barrel as they are the only <br />vendor. Nationwide all companies are trying to limit their liability regarding the Y2K <br />situation and Virginia is a friendly state for Ericsson. Fortunately, Assistant County <br />Attorney Terry O'Brien is a member of the State Bar of Virginia. <br />Commissioner Adams commented that the Board has learned its lesson regarding <br />single -source vendors. <br />ON MOTION by Commissioner Ginn, SECONDED <br />by Commissioner Stanbridge, the Board <br />unanimously approved the Ericsson Year 2000 <br />Upgrade Proposal with the Governing Law and <br />venue being in the State of Virginia so that the Y2K <br />upgrade can be scheduled and installed in a timely <br />manner, as recommended by staff. <br />MARCH 16, 1999 <br />/.S <br />COPY OF AMENDMENT&ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br />
