Cox, P.ZQ!r-- <br />Civil Engineer <br />SUBJECT: Request for Floodplain Cut and Fill Balance Waiver for Pelican <br />Pointe, Phase n Planned Development <br />REFERENCE: PD -98-06-08/97070035-006 <br />DATE: March 29, 1999 <br />DESCRIPTION AND CONDITIONS <br />Shalloway, Foy Rayman & Newell, Inc. on behalf of Craig Foster the developer of Pelican <br />Pointe Phase 11 Planned Development is requesting a waiver of the cut and fill balance <br />requirement of Section 930.07(2)(d) of the Stormwater Management and Flood Protection <br />Ordinance. Pelican Pointe Phase II received special exception use/conceptual planned <br />development plan approval from the Board of County Commissioners on December 8, <br />1998. The project is located along the west bank of the Indian River Lagoon, east of the <br />US 1/Barber Street intersection in Section 21, Township 31 South, Range 39 East. The <br />entire site is located in special flood hazard area Zone AE with a base flood elevation of <br />9.0 feet N.G.V.D.. The ten year stillwater elevation is 4.7 feet. The proposed <br />displacement of the floodplain below 4.7 feet for which the waiver is requested is 1491.5 <br />cubic yards as indicated in the attached letter from the applicants engineer dated March <br />23, 1999. <br />The project meets the cut and fill balance waiver criteria provided in Section 930.07(2)(d)1. <br />of being situated in an estuarine environment within the 100 year floodplain along the <br />Indian River and in staffs opinion it appears that all other Stormwater Management and <br />Flood Protection Ordinance requirements can be met without adverse impact on other <br />lands in the estuarine environment. <br />A separate request for a Land Development Permit has been received by the Public Works <br />Department. <br />Alternative No. 1 <br />Approve the cut and fill balance waiver request. <br />Alternative No. 2 <br />Deny the waiver request and require redesign to accomplish an on-site balance of cut and <br />fill. <br />RECOMMENDATIONS <br />Staff recommends approval of Alternative No. 1. <br />APRIL 69 1999 <br />0 <br />-24- • <br />
