s <br />On March 16,1999,the Board of County Commissioners adopted an ordinance redesignating the <br />subject properties to C-1. Consistent with state law, however, the effective date of that ordinance <br />is when the land use designation amendment is found "in compliance" by the State Department of <br />Community Affairs (DCA). According to state law, DCA must determine that the amendment is <br />either "in compliance" or "not in compliance" within 45 days from receipt of the amendment. DCA <br />has not yet formally made that determination. Therefore, at this time, the future land use patterns <br />in the area of the subject properties are as follows: <br />- Subject Property 1 <br />With the exception of estuarine wetlands along the Indian River Lagoon, Subject Property 1 and all <br />surrounding properties are designated M-2, Medium -Density Residential -2, on the county's future <br />land use map. The M-2 designation permits residential uses with densities up to 10 units/acre. <br />The estuarine wetlands along the Indian River Lagoon are designated C-2, Estuarine Wetlands <br />Conservation -2. The C-2 designation permits residential uses with densities up to lunit/40 acres on <br />site or off site density transfer credits of up to 1 unittacre. <br />- Subject Property 2 <br />Subject Property 2 is designated C-2 on the county's future land use map. Nearby lands on the <br />barrier island, to the east of Subject Property 2, are designated L-1, Low -Density Residential -1, on <br />the county's future land use map. The L-1 designation permits residential uses with densities up to <br />3 units/acre. <br />- Subject Property 1 <br />Providing habitat to several species of listed wading birds, Subject Property 1 consists of *21 acres <br />of coastal oak hammock and ±16 acres of wetlands (impounded estuarine salt marsh) associated with <br />the Indian River Lagoon. The subject property is within an "AE" 100 year floodplain, with a <br />minimum base flood elevation requirement of six to seven feet NGVD. <br />- Subject Property 2 <br />Subject Property 2 consists of ±15.8 acres of impounded estuarine wetlands associated with the <br />Indian River Lagoon. Subject Property 2 also provides habitat for several species of listed wading <br />birds. Mangroves are the primary native vegetation on the site. The subject property is within an <br />"AE" 100 year floodplain, with a minimum base flood elevation requirement of five feet NGVD. <br />Utilities and Services <br />- Subject Property 1 <br />Water lines extend to Subject Property 1 from the South County Reverse Osmosis Plant, while <br />wastewater lines extend to the site from the South Regional Wastewater Treatment Plant. <br />- Subject Property 2 <br />Water lines extend to within a quarter mile of Subject Property 2 from the City of Vero Beach Water <br />Plant, while wastewater lines extend to within a quarter mile of the site from the City of Vero Beach <br />Wastewater Treatment Plant. <br />- Subject Property I <br />Subject Property 1 abuts Indian River Boulevard which is classified as an urban principal arterial <br />road on the future roadway thoroughfare plan map. This segment of Indian River Boulevard is a <br />four -lane paved road with approximately 150 feet of public road right-of-way. There are no plans <br />to expand Indian River Boulevard <br />- Subject Property 2 <br />Subject Property 2 cannot be accessed directly from an automobile. Island Drive, a private local <br />road, links the site to SR AIA. Classified as an urban minor arterial, that segment of SR AIA is a <br />two lane paved road with approximately 100 feet of public road right-of-way. That segment of SR <br />A 1 A is programmed for expansion to an urban principal arterial with 120 feet of public road right- <br />of-way by 2020. <br />APRIL 6, 1999 <br />• <br />-75- BOOK U3 FAGE 833 <br />
