_I <br />BOOK 103 i-,q,Gr 836 <br />ORDINANCE NO. 99- 11 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RS -1 TO CON -1, FOR <br />PROPERTY LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF 8TH <br />STREET AND INDIAN RIVER BOULEVARD; AND FROM RS -1 TO CON -1, FOR PROPERTY <br />LOCATED WEST OF ST. CHRISTOPHER'S HARBOR SUBDMSION, AND DESCRIBED <br />HEREIN, AND PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on <br />such matters, has held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida, to -wit: <br />The South one-half of Government Lots 7 and 8, Section 7, Township 33 South, Range 40 <br />East, Indian River County, Florida, LESS AND EXCEPT that parcel described in Official <br />Record Book 719, Page 76, Public Records of Indian River County, Florida. <br />0 <br />Part of an island lying west of Government Lot 3 as described in Deed Book 82, Page 531 <br />and Record Book 100, Page 198, Public Records of Indian River County, Florida. Together <br />with Part of an island lying west of Government Lot 4 as described in Deed Book 81, Page <br />583 and Record Book 100, Page 198, Public Records of Indian River County, Florida. <br />Be changed from RS -1 to Con -1. <br />All with the meaning and intent and as set forth and described in said Land Development <br />Regulations. <br />Effective Date: This ordinance shall become effective upon the issuance by the State Department <br />of Community Affairs of a Notice of Intent to find the related Comprehensive Plan Land Use <br />Designation Amendment contained in Ordinance Number 99-07 in compliance in accordance with <br />s. 163.3184(9) or the issuance of a final order by the Administration Commission finding the <br />referenced amendment in compliance with s. 163.3184(10). <br />Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on <br />this 6" day of April, 1999. <br />APRIL 6, 1999 <br />0 <br />-78- 0 <br />
