Oaklsland Contract for Construction ofReauiredlmprovements <br />- 90 -Day Extension to Complete Landscaping Work <br />The Board reviewed a Memorandum of April 30, 1999: <br />TO: The Board of County Commissioners <br />FROM: P'- William G. Collins II - Deputy County Attorney <br />DATE: April 30, 1999 <br />SUBJECT: Oak Island Contract for Construction of Required Improvements - <br />Request for a 90 -Day Extension to Complete Landscaping Work <br />On April 26, 1999 1 received a request from the developer of Oak Island for an <br />extension in time of 90 days to complete performance of the Contract for <br />Construction of Required Improvements at Oak Island. Code Section <br />913.10(1)(E) provides that for good cause shown, the Board of County <br />Commissioners may in its discretion grant one or more extensions of time for <br />performance of any contract for required improvements, provided surety <br />supporting such contract remains valid for the required 90 -day period following <br />the newly extended time for performance. <br />The developer is requesting an additional 90 days to install landscaping involving <br />littoral planting and an agricultural buffer. He believes they will have more <br />success in the installation of new plantings during the upcoming rainy season <br />than would had been possible during the last few months of drought. The <br />security supporting the contract for required improvements remains in place. <br />Upon certification by the project engineer that all or a substantial portion of <br />required improvements have been completed, and upon inspection by the Public <br />Works Department, the staff, per Code, will process a release of that portion of <br />security no longer required. <br />RECOMMENDATION: <br />Grant the requested extension until August 12, 1999 to install landscaping at <br />Oak Island. <br />ON MOTION by Commissioner Ginn, SECONDED BY <br />Commissioner Adams, the Board unanimously granted the <br />requested extension until August 12, 1999 to install landscaping <br />at Oak Island due to recent and current drought conditions, as <br />requested. <br />MAY 119 1999 <br />23 <br />BOOK FF1v <br />• <br />
