• <br />On February 13, 1990, the county, approved its comprehensive plan, including a new future land use <br />map. After negotiation and amendment, that plan and map were found to be "In Compliance" by <br />the State Department of Community Affairs on August 15, 1991. With the adoption of the new <br />future land use map, the zoning of many parcels was no longer consistent with the future land use <br />map. For that reason, the county adopted a county -wide administrative rezoning on July 21, 1992. <br />Planning staff recently discovered that the subject property was mistakenly omitted from that <br />administrative rezoning. The purpose of this request is to change the zoning of the site to be <br />consistent with its land use designation. <br />On May 27, 1999, the Planning and Zoning Commission voted 5 to 0 to recommend that the Board <br />of County Commissioners approve the proposed rezoning. <br />State law provides some special requirements for rezoning requests, such as the subject request, that <br />are county initiated and involve more than ten acres. The most relevant of those special <br />requirements are the following: <br />• The Board must hold two advertised public hearings; <br />• One of the public hearings must be after 5:00 p.m. on a weekday, unless four Commissioners <br />vote to conduct that hearing at another time of day; and <br />• The second hearing must be held at least ten days after the first hearing and must be <br />a ,-✓crtiscd at least five days prior to the second hearing. <br />The July 13, 1999 Board of County Commissioners meeting meets the requirements for one of the <br />public hearings. Provided the advertising requirements are met, the second hearing can be held on <br />any weekday atter July 23, 1999, at a time determined by the Board of County Commissioners. The <br />rezoning ordinance then can be adopted at the second hearing. <br />The site and lands to the east, west and north consist of vacant undisturbed pine flatwoods and <br />possibly wetlands and scrub habitat. The subject property is zoned RM -6. Abutting land on the <br />north and west is zoned RS -3. Land bordering the site on the east is zoned EL, Light Industrial. <br />South of 65d' Street, much of the land in this area of the county has been approved for the Southern <br />Dunes Golf Course. Directly south of the subject property, land is zoned A-1, Agricultural (up to <br />1 unit/5 acres) and is undeveloped except for a trash transfer station and a transmission tower. <br />The subject property and land to the west and north are designated L-1, Low -Density Residential -1 <br />on the future land use map. The L-1 designation permits residential uses with densities of up to 3 <br />unitstacre. To the south of the site, land is designated L-2, Low -Density Residential -2, on the future <br />land use map. The L-2 designation permits residential uses with densities of up to 6 units/acre. <br />Property abutting the site on the east is designated C/I, Commercial/Industrial, on the future land use <br />map.
