BOOK i0 J PAGE ,- . <br />SECTION 4 SEVERABILITY <br />If any section, sentence, clause, or phrase of this ordinance is held to be invalid <br />or unconstitutional by any court of competent jurisdiction, then said holding shall In no <br />way affect the validity of the remaining portions of this ordinance. <br />SECTION 5. EFFECTIVE DAT <br />This ordinance shall take effect upon filing with the Florida Secretary of State. <br />The ordinance was advertised in the Vero Beach Press Journal on the <br />day of , 1999, for a public hearing to be held on the day of <br />, 1999, at which time it was moved for adoption by Commissioner <br />the following vote: seconded by Commissioner , and adopted by <br />Chairman Kenneth R. Macht <br />Vice Chairman Fran B. Adams <br />Commissioner Caroline D. Ginn <br />Commissioner Ruth Stanbridge <br />Commissioner John W. Macht <br />Chairman <br />ACKNOWLEDGMENT of filing with the Department of State of the State of Florida, this <br />day of .1999. <br />County Attorney Vitunac noted that this item was proposed by Students Working <br />Against Tobacco (SWAT). Another county has already passed this ordinance and legal staff <br />thinks it is satisfactory. He introduced some members of SWAT for a quick update on their <br />research. <br />Leslie Cracraft of Indian River County Health Department noted that in recent <br />surveys taken by the students, approximately 2 weeks ago, Eckerd's is displaying cigars next <br />to school supplies and candy. Ms. Cracraft then introduced: Nancy McClain, SWAT <br />Coordinator of the Substance Abuse Council; Joe Acquafredda and Sara Hansen of <br />Sebastian River Middle School; Todd Fox and Jennifer Stabe of Gifford Middle School; <br />Alisha Page and Larissa Feretti of Oslo Middle School; and Tricia Acquafredda and <br />Chana Morales of Sebastian River Middle School. <br />The students thanked the Board for their support and requested that the Board adopt <br />the ordinance. <br />JULY 20,1999 <br />COPY OF HANDOUT PRESENTED BY SWAT IS ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />-54- <br />
