EO0K 10 0 PAGE 94"]" <br />Commissioner Stanbridge called on Environmental Planner Brian Poole who stated <br />that this matter had been explained to him as follows: The developer, Lost Tree Village <br />Corporation, went to SJRWMD with a conceptual plan for the island development, which <br />did not include the bridges. LTVC actually has submitted a permit application for the <br />bridges to the Coast Guard. There was a lawsuit, a hearing, and they are waiting for the <br />administrative law judge to make a ruling as to whether or not the bridges will go over State- <br />owned lands. In the meantime, SJRWMD is issuing an intent to deny the permit application <br />because they are assuming that it is State-owned land because the Board of Trustees of the <br />Internal Improvement Trust Fund of the State of Florida have said that they will assert title. <br />If the administrative law judge rules against the Trustees and says they are not State-owned <br />lands, the likelihood is that denial will be reversed and SJRWMD will propose approval. <br />Commissioner Stanbridge stressed that this issue is totally separate from the Coast <br />Guard application on which the Board had sent a resolution. The Coast Guard application <br />has been extended and she believed the environmental assessment will be considered by <br />MANWAC. To further complicate matters, along with the SJRWMD permit, there is also <br />a Corps of Engineers permit. In this case, the applicant, LTVC, chose to go with a <br />nationwide permit application and publication of notice in an obscure journal. She warned <br />that this is a case of "divide and conquer" which typically occurs in permitting. When the <br />developer has all their permits in hand, he goes to the local government and says, we have <br />all these other permits and no one has a problem with our plan. She believed local <br />government needs to deal with this problem. <br />Environmental Planning & Code Enforcement Chief Roland M. DeBlois added a <br />comment that MANWAC is scheduled to review the Coast Guard permit at their August 16'h <br />meeting; and on that same date is the Extended Time Line Deadline for comments to the <br />Coast Guard. He requested authorization to submit comments directly to the Coast Guard <br />on behalf of MANWAC and County and will report back to the Commission. <br />Commissioners had no objections. <br />Upon Commissioner Ginn's question about the application to the Corps of Engineers, <br />Mr. Poole advised that he had placed a call to Irene Sadowsky of the Corps of Engineers to <br />find out specifically whether the County can still make comments on the LTVC permit <br />application.
