ON MOTION by Commissioner Stanbridge, <br />SECONDED by Commissioner Adams, the Board, <br />by a 4-0 vote (Commissioner Grin being absent) <br />approved the exercise of the Option Agreement with <br />Annette R Roberts, Trustee, and authorized staff to <br />proceed with obtaining two appraisals for the <br />property, as required by the School District, as <br />recommended by staff and directed the County <br />Attorney to draft language for insertion in the next <br />proposed option agreement that would protect the <br />County's deposit should the seller back out of the <br />contract. <br />12. JUNGLE TRAIL RIGHT-OF-WAY SWAP - BERMUDA CLUB <br />ASSOCIATES (FLORIDA LAND COMPANY 40 -FOOT RIGHT - <br />OF -WA <br />The Board reviewed a Memorandum of July 28, 1999: <br />TO: The Board of County Commissioners <br />FROM: ttt--William G. Collins II - Deputy County Attorney <br />DATE: July 28, 1999 <br />SUBJECT: Jungle Trail Right -Of -Way Swap <br />On April 6, 1999 the County Commission approved conceptual PD plan and <br />special exception use request for the Bermuda Club. One of the conditions was <br />that the County would exchange the 40 -foot right-of-way through the Bermuda <br />Club property deeded to it by the Florida Land Company in 1984 in exchange for <br />a deed to the existing traveled way of Jungle Trail as it passes through the <br />Bermuda Club property. <br />The County Deed has been executed and I am holding it in escrow pending <br />receipt of an acceptable deed from the Bermuda Club. I transmitted a deed to <br />the owners of the Bermuda Club property on May 27, 1999. On June 7, 1999 <br />Mr. Genoni, representing the Bermuda Club, wrote a letter requesting <br />assurances that the County will not use the Jungle Trail right-of-way for parking <br />or public access to the river, considering that the County Commission approved <br />the Bermuda Club development with a condition prohibiting any vehicular parking <br />on their property west of Jungle Trail. <br />On July 16, 1999 Mr. Genoni delivered a deed from the Bermuda Club that had <br />provisions for reversion of the property to the Bermuda Club if the violation of <br />any of three conditions stated in the deed occur. The County Attorney did not <br />feel such a deed was acceptable, given that the property could revert due to <br />activities beyond the control of the County. <br />AUGUST 3, 1999 <br />fi <br />-55- BOOK 110 Ff Gr <br />
