Collins II - Deputy County Attorney <br />DATE: August 25, 1999 <br />SUBJECT: ' Corrective Deed <br />On February 6, 1945 Indian River County deeded 20 acres of property in Tract 8, <br />Section 12, Township 33 South, Range 38 East, to the Indian River Farms <br />Drainage District. This tract is a portion of the Pointe West traditional <br />neighborhood design project. Ira Hatch, Esq. on behalf of Pointe West has <br />requested a corrective deed to clear title to a hiatus resulting from the tract being <br />40.89 rather than exactly 40 acres. <br />Because the description is not of the hiatus itself but rather the entire tract, we <br />have reserved to the County any existing right-of-way for 12th Street and 74th <br />Avenue, as well as any easements of record. <br />RECOMMENDATION: <br />Authorize the Chairman to execute the attached Quit -Claim Deed to correct the <br />hiatus in the 1945 deed. <br />ON MOTION by Commissioner Adams, SECONDED BY <br />Commissioner Stanbridge, the Board unanimously (4-0, <br />Commissioner Ginn absent) authorized the Chairman to execute <br />the Quit -Claim Deed to correct the hiatus in the 1945 deed to <br />the Indian River Farms Drainage District, as recommended in <br />the Memorandum. <br />COPY OF COUNTY DEED IS ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />7.N.
