TO: The Board of County Commissioners <br />FROM: William G. Collins II - Deputy County Attorney <br />DATE: September 8, 1999 <br />SUBJECT: Modification to River Boat Club Dock License Insurance. <br />Requirements <br />In conjunction with the development of the River Boat Club, the Board of County <br />Commissioners approved the License Agreement dated January 17, 1995 with <br />the River Boat Club Property Owners' Association, Inc. The Agreement <br />authorized the construction of a multi -slip common dock facility for the personal <br />recreational use of the residents of the River Boat Club Subdivision on a canal <br />lying south of 95th Street. <br />The developer has turned over control of the association to the residents who <br />have written to request a modification to the insurance requirements of the <br />License Agreement. Paragraph 6 of the License Agreement requires the County <br />to be named as an additional insured in the amount of $5,000,000 liability <br />insurance. The requested modification would lower liability insurance to <br />$1,000,000. The County Risk Manager has no objection to lowering the liability <br />insurance coverage. This seems reasonable given the limitation on the waiver of <br />sovereign immunity in Section 768.28, Florida Statutes. The County's liability to <br />pay a claim or a judgment by any one person is limited to $100,000 and all other <br />claims or judgments arising out of the same incident or occurrence are limited to <br />$200,000. <br />RECOMMENDATION: <br />Authorize the Chairman to execute the attached Modification to License <br />Agreement lowering the required liability insurance limit to $1,000,000. <br />ON MOTION by Commissioner Ginn, SECONDED BY <br />Commissioner Stanbridge, the Board unanimously authorized <br />the Chairman to execute the Modification to License Agreement <br />with River Boat Club lowering the required liability insurance <br />limit to $1,000,000, as recommended in the Memorandum. <br />RECORDED MODIFICATION TO LEASE AGREEMENT IS ON FILE <br />IN THE OFFICE OF TBE CLERK TO THE BOARD <br />SEPTEMBER 219 1999 <br />19 <br />
