At that time, in accordance with state and federal regulations, an MPO <br />apportionment plan was prepared and adopted. That apportionment plan specifies the MPO's <br />planning area and the structure of the MPO's nine member Policy Board. <br />The 1993 apportionment plan analyzed several options regarding the structure of the MPO's Policy <br />Board. The option selected and in place since 1993 is a nine member Board consisting of four <br />County Commissioners, two Vero Beach City Councilmen, one Sebastian City Councilman, one <br />Fellsmere City Councilman, and one Indian River Shores Town Councilman. In addition, the MPO <br />Policy Board includes two nonvoting members. These are representatives of the Town of Orchid <br />and the Indian River County School District (IRCSD). <br />During preparation of the 1993 apportionment plan, it was agreed that the IRCSD should have voting <br />membership on the MPO Board In 1993, however, FDOT's interpretation of Chapter 339.175, F.S., <br />which governs the apportionment of MPO Policy Boards, was that school boards were not allowed <br />voting membership on MPO Policy Boards. <br />Since 1993, FDOT's position regarding school board voting representation on MPO Policy Boards <br />has changed This is based on Chapter 339's provision that representatives of agencies operating <br />major modes of transportation may have voting representation on MPO Boards, and a recognition <br />that school boards are agencies operating a major mode of transportation. In Indian River County, <br />the IRCSD provides a greater number of trips over a greater number of miles with a larger fleet than <br />any other transportation provider, including the County's public transportation provider. <br />Recently, the IRCSD requested voting membership on the MPO Board. This change required the <br />MPO to update its original 1993 apportionment plan. At the February 10, 1999 MPO meeting, the <br />MPO unanimously approved its updated 1999 apportionment plan (Attachment 1). The 1999 plan <br />differs from the 1993 plan by the addition of one voting member from the IRCSD to the MPO <br />Board. Table 4 depicts the MPO Board structure established by the Indian River County MPO's <br />1999 apportionment plan. <br />The MPO's 1999 apportionment plan must be also be accepted or rejected by resolution by each <br />representative local government and then transmitted to FDOT and the Governor's Office for <br />approval. To date, each local government, including the IRCSD, has approved the MPO's <br />apportionment plan with the exception of the City of Vero Beach which did not approve the <br />apportionment plan. <br />Now that all municipalities have considered the MPO's apportionment plan, the Board of County <br />Commissioners must also accept or reject the apportionment plan by resolution. Staff has prepared <br />an acceptance resolution which is attached to this staff report (Attachment 2). <br />Staff recommends that the Board of County Commissioners review the Indian River County MPO <br />1999 apportionment plan and acceptance resolution, make any necessary changes, and approve the <br />resolution. <br />Indian River County MPO 1999 Apportionment Plan <br />Apportionment Plan Acceptance Resolution <br />October 19, 1999 <br />46 <br />
