BOOK iii PAGE 102 <br />discharge, environmental concerns, and public access restriction concerns. The License <br />Agreement has been jointly crafted by the County Attorney's office. the Utilities <br />Department, and the SOPOA, and represents a reasonable concession by the County for <br />the use proposed. <br />The License, and associated Annex 1, provides for the multiple use of County property <br />by permitting adjacent buffer area, contiguous to the wastewater facility, to accommodate <br />temporary structures to serve the Sea Oaks community. Specifically, the License <br />provides for the following: <br />I) The ownership interest of water meters located inside certain Sea Oaks <br />Dunehouses, be conveyed to the respective Boards; leaving utility responsibility <br />limited to the property line. (See Annex 1, "Metering"). <br />2) A 10 -year, non -cancelable license to use County property shown on Exhibit "A". <br />(See License, Paragraph 1). <br />3) Lawn maintenance, and exotica removal, to be performed by SOPOA on <br />wastewater facility property. (See License, Paragraph 2). <br />4) That limited and conditional construction may take place on County property. <br />(See Amex 1, "Site Planning). County may request vacation of property to <br />accommodate future construction. <br />S) The terms of the 1999 irrigation agreement are maintained (See Annex 1, "Site <br />Planning'). <br />The Department of Utility Services recommends that the Board of County <br />Commissioners authorize the Commission Chair to execute the attached License <br />Agreement, including Annex 1, thereby authorizing the License for use. <br />MOTION WAS MADE by CommissionerAdams, SECONDED <br />BY Commissioner Ginn, to approve staffs recommendation. <br />Commissioner Ginn pointed out a scriveners error on page 112; it should read Exhibit <br />A, not Exhibit 1. <br />The Chairman CALLED THE QUESTION and the motion <br />carried unanimously (4-0, Commissioner Stanbridge absent). <br />(Approved the License Agreement and authorized the Chairman <br />to execute same.) <br />October 19, 1999 <br />
