O'Brien, Assistant County Attorney- q'f <br />v <br />DATE: November 24, 1999 <br />SUBJECT: A Quit Claim Deed of Two County Lots in Fellsmere to the City of <br />Fellsmere <br />The Little League ball field in the City of Fellsmere has been in existence for decades <br />complete with concession stand, rest rooms, lighting and basketball courts. <br />Recently the City applied for a grant to renovate the field. As part of the grant <br />process a title search was conducted. The search showed that two (Lots 1 and 2) of <br />the 24 lots that make up the complex are owned by Indian River County. <br />The City has requested that the County Quit Claim these two lots to the City so <br />that they can proceed with their renovation grant. A copy of the request is <br />attached. <br />The subject property is not needed for County purpose. Accordingly, the property <br />may be conveyed to the City pursuant to Section 125.38, F.S. <br />In view of the foregoing, it is recommended that the Board of County <br />Commissioners adopt the attached resolution authorizing the Chairman to execute <br />a quit claim deed conveying the subject property to the City of Fellsmere without a <br />reverter clause. <br />TPO/sw <br />Attachment <br />ON MOTION by Commissioner Adams, SECONDED BY <br />Commissioner Ginn, the Board unanimously adopted Resolution <br />No. 99-127 authorizing the Chairman to execute a County Deed <br />conveying two County lots to the City of Fellsmere. <br />December 7, 1999 <br />41 <br />BOOK iI iFA E <br />
