BOOK <br />acre single-family zoned parcel, consisting of 38 single family lots and 5 tracts. Four tracts will be <br />used for stormwater management, and one tract will be for a future 331d Street right-of-way. Phase <br />I is located on the north side of 331 Street, approximately 664' east of 666 Avenue. Phase II will be <br />located immediately north of Phase I. <br />At its regular meeting of April 8, 1999, the Planning and Zoning Commission granted preliminary <br />plat approval for the overall subdivision. Subsequently, a land development permit was issued for <br />for Phase I. The developer is now bonding -out all required improvements as part of the final plat <br />approval process. The owner, Oak Chase Development LLC, through its agent Carter Associates <br />Inc., is now requesting final plat approval and has submitted the following: <br />A final plat for Phase I in conformance with the approved Oak Chase preliminary plat. <br />2. A cost estimate for the required Phase I subdivision improvements. <br />3. A contract for construction for the required Phase I subdivision improvements. <br />4. A letter of credit to guarantee construction of the required improvements. <br />ANALYSIS: <br />At this time, none of the required Phase I subdivision improvements have been completed. The <br />applicant has submitted a contract for construction for all of the required Phase I subdivision <br />improvements, along with a letter of credit to secure the contract. Both the county engineering <br />division and the utility services department have approved the cost estimate and have verified that <br />the letter of credit amount is adequate to cover the estimated cost of the remaining required <br />improvements. The county attorney's office has approved the construction contract for legal form <br />and sufficiency and has approved the format of the letter of credit. <br />All applicable requirements regarding final plat approval have been satisfied. Pursuant to the <br />county's LDRs, the applicant will be required to obtain a certificate of completion after satisfactory <br />completion of the required improvements. At that time, the applicant will warranty the utility <br />improvements via a utility services department Bill of Sale. The other publically dedicated <br />improvements will be wacrantied separately with a warranty and maintenance agreement. These <br />warranties will be required prior to the issuance of a certificate of completion. <br />Based on the above analysis, staff recommends that the Board of County Commissioners grant final <br />plat approval for Oak Chase Phase I and authorize the chairman to sign the contract for construction <br />and accept the letter of credit. <br />1.
