Addition (Anstalt) <br />(after -the -fact reimbursement) <br />Oslo Riverfront South <br />Wabasso Scrub Addition <br />Funding Approval <br />At a public hearing on September 23, 1999, the FCT finalized its ranking of 92 projects submitted statewide <br />asking for —$88 million in grant funds, whereby —$33 million in funds are available. As a result of FCT's <br />ranking, the Oslo Riverfront South project faired the best out of the County's three applications, ranking 7" <br />out of the 92 projects, safely qualifying for 50% cost -share funding. The North Sebastian C.A. Addition <br />(ranked 40" ) also qualified for 50% cost -share fimding. The Wabasso Scrub Addition, ranked 44", qualified <br />as first on a list for contingency funding, whereby cost -share finding will be granted as it becomes available. <br />Conceptual Approval Agreements <br />Since the September FCT hearing, FCT staff has visited the three approved project sites with county staff <br />to verify site conditions as represented in the project applications. In accordance with State procedures, the <br />next step is for the FCT Governing Body and the County Commission to execute a "Conceptual Approval <br />Agreement" for each of the three approved cost -share finding projects. <br />The agreements consist largely of standard language and conditions pursuant to Rule 9K-4, Florida <br />Administrative Code, the rule which sets forth Florida Communities Trust program procedures. Each <br />agreement consists of eight main sections, as follows (paraphrased): <br />I. <br />General Conditions <br />II. <br />Requirements Prior to Initiation of Negotiations <br />(Oslo Riverfront South & Wabasso Scrub Addition) <br />M. <br />Project Plan Approval <br />IV. <br />Project Site Acquisition Requirements <br />V. <br />Obligations as a Condition of Project Funding <br />VI. <br />Obligations Relating to theUse of Bond Proceeds <br />VII. <br />Disallowable Activities/Remedies <br />VIII. <br />Site Specific Management Plan Conditions <br />The General Conditions section of the agreements contains standard language pertaining to tarring and <br />coordination of steps between the County and FCT, and among other things identifies the key contact from <br />the County for purposes of coordinating project activities. <br />Requirements Prior to Initiation of Negotiations pertains to the Oslo Riverfront South and Wabasso Scrub <br />Addition sites. This section outlines a number of steps and time frames including the requirement that the <br />County identify and authorize a representative of the County to execute all FCT documents relating to the <br />acquisition. This section also includes reference to a required Confidentiality Agreement (attached), which <br />must include the names and signatures of local representatives who will be privy to confidential appraisals <br />during the negotiation process. The Wabasso Scrub Addition property is located within the city limits of <br />Sebastian. Therefore, the Conceptual Approval Agreement and Confidentiality Agreement for that project <br />will need to be approved by the City as well as the County. <br />Under this section of the agreement, the County has the opportunity to choose whether the County or FCT <br />will be the responsible party for all negotiation and acquisition activities.
