BOOK PAGE <br />Based upon direction from the Board of County Commissioners, staff initiated a request by Tom <br />Collins to change the county's single-family dock LDRs. The change under consideration would <br />allow use of a dock on a vacant single-family lot prior to occupancy of a residence on that lot. Also, <br />staff has initiated a second LDR amendment to address limited use rights-of-way and adjacent <br />setbacks. Because the single-family dock amendment would affect the listed uses allowed in certain <br />zoning districts, two Board public hearings are required. <br />The Planning and Zoning Commission (PZC) and the Professional Services Advisory Committee <br />(PSAC) have reviewed the proposed amendments. To proceed with the review process for the <br />amendments, the Board must now set dates and times for its required public hearings. <br />Planning staff has coordinated with the county attorney's office concerning state requirements for <br />LDR amendment -hearings. In regard to the two required hearings, Florida statutes provides that <br />one hearing be held after 5:00 p.m., while the other hearing may be held before 5:00 p.m. (e.g. <br />regular Board meeting time). However, the statutes also state that, with 4 or 5 positive votes, the <br />Board could vote to hold both LDR hearings befo 5:00 p.m., such as at a regular Tuesday morning <br />Board meeting. Because the LDR amendments involve only two issues that appear to be non- <br />controversial, it is staffs opinion that the Board should vote by a super -majority to hold both <br />hearings during regular Board of County Commissioners meetings. <br />Based upon a super -majority Board vote, one set of hearing dates which would comply with state <br />hearing and advertising requirements. <br />Hearing D= Time <br />Meeting #1 Regular meeting Tuesday, February 1, 2000 9:05 a.m. <br />Meeting #2 Regular meeting Tuesday, February 15, 2000 9:05 a.m. <br />The Board may establish any other dates that meet state requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board concur with the proposed hearing dates or set other hearing dates <br />to consider the proposed LDR amendments. <br />ON MOTION by Commissioner Macht, <br />SECONDED by Commissioner Stanbridge, the <br />Board, by a 4-0 vote (Vice Chairman Ginn absent), <br />unanimously approved the hearing dates of Tuesday, <br />February 1, 2000 at 9:05 a.m. and Tuesday, <br />February 15, 2000 at 9:05 a.m., as recommended by <br />staff. <br />JANUARY 18, 2000 <br />• -36- <br />• <br />
