RESOLUTION 2000-011 CANCELLING DEtmouENT TAxEs ON <br />PUBLICLY OWNED PROPERTY (CITY OF SEBASTIAN, RIVERVIEW PARK - <br />GOOD GUYS PURCHASE) <br />The Board reviewed a Memorandum of January 28, 2000: <br />TO: Board of Co missioners <br />FROM: Lee R. Keller, CLA <br />Legal Assistant - County Attorney's Office <br />THROUGH: Terry O'Brien, Assistant County Attorney <br />DATE: January 28, 2000 <br />RE: City of Sebastian - Park Property Purchase <br />In November, 1999, the City of Sebastian acquired some river -front property, which was paid <br />for in part from County funds, and, pursuant to Section 196.28, Florida Statutes, the Board may <br />cancel and discharge any taxes owed on the property as long as it was acquired for "public <br />purpose." Such cancellation must be done by resolution of the Board, with a certified copy being <br />forwarded to the Tax Collector. <br />Normally, at closing the seller pays all taxes due up to the time of closing, and taxes for the <br />remainder of the year are canceled. In this case, the City of Sebastian did not collect at closing <br />the taxes that were owed for the previous 11 months. The County has authority to cancel these <br />unpaid taxes. However, if the County adheres to its normal policy, the City will have to pay the <br />back taxes, otherwise the Tax Collector will put it up for sale and a tax certificate will be issued <br />on it. <br />Reauested Action: Request that the Board authorize the Chairman to sign the attached <br />resolution canceling all unpaid taxes on this property. <br />FEBRUARY 8, 2000 <br />-31- �uC i - � Ciq�C <br />• <br />
